2. The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 30(a) and 32(3) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, 94.125 litres of illicit foreign liquor has been recovered from a car. Petitioner is alleged to be owner of the car.

4. It is submitted by learned counsel appearing on behalf of the petitioner that petitioner is owner of the car and he has been made an accused in this case merely on suspicion. Nothing has been recovered from the conscious possession of this petitioner.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner

Patna High Court CR. MISC. No.36617 of 2024(3) dt.04-07-2024 2/2 and submits that petitioner is named in the F.I.R. and has also got two criminal antecedents of similar nature.

6. Considering the aforesaid facts and circumstances and antecedents of the petitioner, the prayer for grant of anticipatory bail to the petitioner is rejected. (Prabhat Kumar Singh, J) shashank/- U T
