The petitioner seeks bail in Bagaha (Pathkhauli) P.S. Case No. 540 of 2020, registered for the offence under Section 394 of the Indian Penal Code.

As per the F.I.R., two persons on the point of pistol looted cash and other articles from the informant and also assaulted by the butt of revolver on informant's head. It is submitted on behalf of petitioner that petitioner has been made accused in this case on the basis of his confession made before the police, which has got no evidentiary value. Petitioner has not been put on T.I.P. No incriminating article has been recovered from the possession of the petitioner and he is in custody since 12.02.2021. Investigation is complete.

Patna High Court CR. MISC. No.41596 of 2021(2) dt.17-01-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st Bagaha, District - West Champaran in connection with Bagaha (Pathkhauli) P.S. Case No. 540 of 2020.
