JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-01-2015 The petitioners are languishing in custody since 22.08.2013 and 08.01.2014 in a case registered for the offences punishable under Section 395 of the IPC.

It is alleged that the dacoity was committed in the petroleum dealership of the informant. Names of the petitioners sprang up on the confession of the co-accused. It is submitted by learned counsel for the petitioners that there is no recovery from the petitioners nor they have been

Patna High Court Cr.Misc. No.23871 of 2014 (4) dt.29-01-2015 put on T.I. parade. A statement to that effect has been made in para 7 and 8 of both petitions respectively. Co-accused have been granted bail by this Court vide Cr. Misc. Nos. 19371 of 2011, 19341 of 2011, 31174 of 2011, 34586 of 2011, 48204 of 2012, 31088 of 2012 and 33587 of 2011.

Considering the fact that the petitioners have not been put on T.I. Parade, let the above named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) each with two sureties of like amount each to the satisfaction of learned CJM, Araria in connection with Araria P.S. Case No. 14 of 2011. Since the petitioners have criminal antecedents, learned court below will be at liberty to cancel the bail bonds of the petitioners if they substantially got involved in some serious nature of offence or default for two consecutives occasions.
