The petitioner apprehends her arrest in a case registered for the offence under Sections 302, 201, 120(B) of the Indian Penal Code.
As per F.I.R., this petitioner alongwith other F.I.R. named accused persons are alleged to have killed the son of informant.
It is submitted on behalf of petitioner that petitioner is none else but daughter-in-law of informant and wife of the deceased and only on suspicion, she has been made accused in this case. Informant is not eye-witness of the occurrence. During course of investigation, no direct or indirect material has been collected against this petitioner to show her involvement in the alleged crime. Petitioner has got clean antecedent.
Patna High Court CR. MISC. No.32335 of 2022(2) dt.10-10-2022 2/2 Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
Considering the nature of accusation and the fact that petitioner is lady and has got clean antecedent, in the event of her arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Vaishali (Hajipur) in connection with Raghopur (Rustampur O.P.) P.S. Case No. 116 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
