JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 08-12-2021 A sixth supplementary show cause has been filed on behalf of the opposite party nos. 2 and 3 who are the District Magistrate, Purnea and the Sub-Divisional Officer, Dhamdaha in the district of Purnea respectively. Paragraph '5' of the sixth supplementary show cause is quoted hereunder for a ready reference:- "That it is humbly and respectfully submitted that as there is no
Patna High Court MJC No.3986 of 2016(17) dt.08-12-2021 2/2 fresh vacancy for P.D.S. license in Gram Panchayat-Laxmipur, Block-Rupouli, District-Purnea these respondents are unable to grant P.D.S. license to the petitioner. But it is certified that if fresh vacancy is created in future for P.D.S. license in Gram PanchayatLaxmipur, Block-Rupouli, District-Purnea and the petitioner make an application for obtaining that P.D.S. license his application will definitely be duly and properly considered."
Mr. S. Raza Ahmad, learned AAG-5 is representing opposite party nos. 2 and 3. Learned AAG-5 has categorically submitted before this Court that the undertaking which is recorded in paragraph '5' of this sixth supplementary show cause shall be given effect to without any rider in future and the case of the petitioner shall be considered.
Mr. Vijay Anand, learned counsel for the petitioner submits that the petitioner would be satisfied with the consideration of his name against the future vacancy. In the aforesaid view of the matter, this contempt application is dropped and be taken as disposed of.
