The petitioner has preferred this application for grant of regular bail in a case registered under section 3 of the R.P.U.P. Act.

As per the prosecution case, the petitioner was arrested and 41 sacks weighing 50 kg each of grains were recovered.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No incriminating article has been recovered from the petitioner's possession who is in custody since 20.4.2021 and has no criminal antecedent. It is submitted that for the first offence, the sentence under section 3 of the R.P. U.P. Act, 1966 would be imprisonment for a term which may extend to five years or fine

Having heard learned counsel for the parties and taking into consideration the petitioner not having any criminal antecedent and having remained in custody for more than 10 months, the Court directs the petitioner to be enlarged on bail in connection with Hajipur R.P.F. P.S. Case no.4 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Rail Judicial Magistrate, Sonepur, Saran.
