The petitioner seeks pre-arrest bail in connection with Khagaul P.S. Case No.10 of 2017 registered for the offences punishable under Sections 147, 153A, 298, 149 and 436 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that similarly circumstanced other co-accused persons namely, Vijan Paswan @ Braj Nandan Paswan @ Vijay Paswan, Sanjeet @ Sanjeet Kumar, Hari Om @ Bittu, Rishi @ Rishi Kumar, Sankar Sah, Rohit @ Rohit Kumar and Bipta @ Deepak Kumar have already been granted bail vide orders passed in Cr. Misc. Nos.35901 of 2017 and 29771 of 2018. In support of his submission, he has drawn my attention towards Annexure-3 series to the present application.

Patna High Court Cr.Misc. No.64675 of 2018(2) dt.12-12-2018 2/2 Learned counsel for the State admits that the case of the petitioner stands on identical footing to that of others who have already been granted pre-arrest bail.

In that view of the matter, in the event of arrest or surrender in the court below within a period of six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Danapur in connection with Khagaul P.S. Case No.10 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
