The petitioner seeks bail in Hajipur Town P.S. Case No. 971 of 2019, registered for the offence under Section 413 / 414 / 34 of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith two other associates namely Rakesh Kumar @ Don and Viraj Sahani were moving on a stolen motorcycles and when police reached there, all of them fled away leaving their motorcycles. Nearby people disclosed the name of petitioner and other coaccused. It is submitted on behalf of petitioner that neither any incriminating article has been recovered from the conscious possession of the petitioner nor he was arrested on spot and only

Patna High Court CR. MISC. No.41598 of 2021(2) dt.17-01-2022 2/2 on suspicion, he has been made accused by the so-called identification of local people. Petitioner is in custody since 17.05.2020. Chargesheet has been submitted.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Hajipur Town P.S.
