2. The petitioner has renewed his prayer for bail in connection with Sessions Trial no. 31 of 2021 (arising out of Sikty (Bardaha) P.S. Case no. 172 of 2019 registered under sections 304B, 201 and 34 of the Indian Penal Code.
3. As per the prosecution case, the sister of the informant who was married to the petitioner, was tortured by the accused persons including the petitioner who happens to be the husband for non-fulfillment of demand of dowry. She was ultimately done to death.
4. It is submitted by learned counsel for the petitioner that the prayer for bail of the petitioner was rejected earlier vide
Patna High Court CR. MISC. No.33645 of 2023(3) dt.28-06-2023 2/2 order dated 16.1.2023 (Annexure-1) passed in Cr. Misc. no. 26401 of 2022 giving liberty to the petitioner to renew his prayer for bail in the learned trial Court on framing of charge. It is submitted that the charge has been framed on 22.11.2022. The petitioner is in custody since 22.8.2020.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the liberty granted by earlier order dated 16.1.2023, the petitioner being in custody for more than 2 year 9 months since 22.8.2020 and charge having been framed, the Court directs the petitioner to be enlarged on bail in connection with Sessions Trial no. 31 of 2021 (arising out of Sikty (Bardaha) P.S. Case no. 172 of 2019 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District and Sessions Judge II, Araria. (Partha Sarthy, J) Prakash/- U
