Petitioner is apprehending arrest in connection with Rajoun PS Case No. 564 of 2017 for the offence under Section 302/34 of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that from the FIR it would be evident that petitioner and the coaccused were seen talking with the deceased and as such they have been made accused in the instant case. The deceased committed suicide by hanging herself by her dupatta. The FIR indicates that it is not a case of suicide but murder committed by the two persons who were seen talking with the girl. Learned counsel further submits that the co-accused Deepak Kumar has been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 44279 of 2018 vide order dated
Patna High Court Cr.Misc. No.62631 of 2018(2) dt.13-12-2018 2/2 04.09.2018 Considering the aforesaid, this application is allowed. Accordingly, in the event of arrest or surrender before the court below within a period of one month from today, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Rajoun PS Case No. 564 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
