The petitioner is in custody since 02.09.2019 in connection with Gopalganj (Mahila) P.S. Case No. 31/2018 registered for the offences punishable under Sections 493/376/34 of the Indian Penal Code and Section 4/6 of the POCSO Act.

Earlier the bail application of this petitioner was rejected by this Hon'ble High Court vide order dated 06.02.2020 passed in Cr. Misc. No. 7137 of 2020. Vide order dated 08.12.2020, a report was called for from the Court of learned Additional District and Sessions Judge I cum Special Judge, POCSO, Gopalganj, with regard to stage of trial in connection with Gopalganj (Mahila) P.S. Case

Patna High Court CR. MISC. No.32817 of 2020(3) dt.19-01-2021 2/2 No. 31/2018 which is kept at Flag 'A'.

It appears from the Report dated 17.12.2020 that after framing of charge, two witnesses have already been examined and the case is in evidence stage.

Considering the aforesaid facts and circumstances and the stage of trial, I am not inclined to grant bail to this petitioner. It is, accordingly, rejected.
