1. Heard learned counsel for the petitioners and learned APP for the State.
2. The petitioners apprehend their arrest in connection with Bhargama P.S. Case no.303 of 2024 registered under Sections 191(2), 191(3), 190, 126(2), 115(2), 118(1) and 352 of the B.N.S, 2023.
3. As per the prosecution case, on 25.09.2024, all 13 F.I.R named accused persons including the petitioners herein came to the house of the informant variously armed and started abusing the informant. On the order given by one Neelam Devi (petitioner no.2), accused Manoj Yadav assaulted the cousin brother of informant on head by means of sword causing
Patna High Court CR. MISC. No.32635 of 2025(3) dt.26-06-2025 2/3 injuries to him. Accused Sanichar Yadav assaulted the father of the informant with an iron rod on his head due to which he sustained injuries.
4. Learned counsel for the petitioners submits that the occurrence has taken place on ground of land dispute and a case was filed by the petitioner no.2 Neelam Devi a day prior to the present F.I.R against the family members of the informant. The present F.I.R has been lodged after a delay of four days of occurrence and no explanation has been tendered on behalf of the informant. So far as allegations in the F.I.R, the same is specific against petitioner no.1 Manoj Yadav and accused Shanichar Yadav. However, injuries annexed as Annexure-P/3 and P/4 indicates that injured persons have received simple injuries caused by hard and blunt object. The petitioners undertake to cooperate in the case/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. In view of the entire facts and circumstances of the case, it is directed that the petitioners above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Bhargama P.S. Case no.303 of 2024 on each of

No.32635 of 2025(3) dt.26-06-2025 3/3 them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Araria, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
