The petitioner seeks bail in a case registered under Sections 20, 22, 23, 24, 25, 29 of the N.D.P.S. Act. Allegation is that one kg charas is recovered from the house of Gyan Sah.

It has been submitted on behalf of the petitioner that the petitioner is in custody 01.10.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. From the possession of co-accused, one kg of charas is alleged to have been recovered. There is no recovery of contraband from the conscious possession of the petitioner. The petitioner has been made

Patna High Court CR. MISC. No.30450 of 2019(3) dt.17-05-2019 2/2 accused due to mistake of fact. The name of the petitioner has transpired in the present case on disclosure made by co-accused. Other co-accused has been granted bail vide Annexure 2 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bettiah, West Champaran in connection with Bettiah (T) P.S. case No.511 of 2017.
