Heard learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner seeks bail in a case registered for the offence under Sections 302,120(B)/34 of IPC. According to FIR, the son of the informant alongwith three persons named in the FIR had gone to attend the call of nature and the son of the informant made alarm that some one had pierced dagger then his three friends ran towards him and found that three persons of village Nadaura were fleeing and the petitioner and other could not be identified. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No. 33281 of 2022(4) dt.16-02-2023 2/2 petitioner has clean antecedent. He has falsely been implicated in the present case. Allegation as alleged in the FIR is that the petitioner, namely, Prince Kumar @ Chhotu Bind has inflicted knife blow on the son of the informant.
Learned A.P.P. for the State, on the basis of the material available on the record and the case diary, has vehemently opposed the prayer for bail of the petitioner and submits that the Doctor has found single blow of dagger on the person of the deceased and there is direct allegation against the petitioner.
Considering the aforesaid facts, I am not inclined to enlarge the petitioner on bail in connection with Kurtha P.S.Case No.182 of 2019 pending in the court of learned J.M. 1st Class, Arwal.
Prayer is refused.
