The petitioner seeks bail in connection with Special Case No. 3951 of 2020, arising out of Agamkuan P.S. P.R. No. 40 of 2020, instituted for the offences under Sections 30(a), 32(1), 32(3), 41(1) and 41(2) of the Bihar Prohibition and Excise Act, 2016.

It appears that 87.120 litres of liquor was

Patna High Court CR. MISC. No.31116 of 2020(2) dt.01-02-2021 2/2 recovered from a vehicle which was being driven by the petitioner. He is said to have been arrested on chase by the police party.

It was pleaded before the Court below that the petitioner was suffering from typhoid.

The petitioner is stated to be in custody since 17.06.2020.

Regard being had to the nature of accusation against the petitioner and his period of custody and also taking into account that he is a person of clean antecedents, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 3951 of 2020 arising out of Agamkuan P.S. P.R. No. 40 of 2020.
