2. The petitioner in the present case is seeking prearrest bail in connection with Kudhani (O.P.- Turki) P.S. Case No. 712 of 2020 registered for the offence under Section 392 of the Indian Penal Code. He has one criminal antecedent.
3. As per the prosecution story, on 11.11.2020 at around 08:30 P.M. when the informant was going to Tenia from Muzaffarpur, the three accused persons on motorcycle along with two other associates surrounded him and assaulted him with fist and leg. They also snatched the bag which had Rs.6,470/- two mobile handsets, purse and ATM card.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. It is further submitted that nothing has been recovered from the house of the
Patna High Court CR. MISC. No.33348 of 2023(2) dt.21-07-2023 2/2 petitioner.
5. Learned counsel for the State has opposed the prayer for anticipatory bail of the petitioner.
6. Having regard to the materials present on the record that not only the name of the petitioner has transpired in the statement of the co-accused, rather it is said that he had arranged for the arms and he has also got one criminal antecedent of the year 2019, this Court is not inclined to grant privilege of prearrest bail to the petitioner.
7. Prayer is refused.
8. This application stands dismissed.
