Mr. Shantanu Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 02-03-2021 Heard Mr. Sharda Nand Mishra, learned counsel for the petitioner and Mr. Shantanu Kumar, the learned APP for the State.

The petitioner seeks bail in connection with Kumarkhand P.S. Case No. 84 of 2013 dated 16.06.2013 which initially was instituted for offences under Sections 147, 148, 149, 323, 324, 341 and 307 of the Indian Penal Code but later with the death of the deceased Section 302 IPC was added.

Though the petitioner has been named in the FIR but the allegation of assault on the deceased is specifically attributed to co-accused Rasul Mian and Md. Jabar Mian.

So far as the petitioner and others are concerned, they are only said to be the members of the

Patna High Court CR. MISC. No.31097 of 2020(3) dt.02-03-2021 2/2 mob.

Some of the other accused persons of this case have been granted bail by different Benches of this Court, which orders have been annexed with the bail petition.

The petitioner is in custody since 24.02.2020. Mr. Mishra, learned Advocate for the petitioner has also informed this Court that there is no progress in the stage of the case before the court below after the submission of charge sheet.

Considering the aforenoted submissions and the period of custody of the petitioner as well as the nature of accusation against him, he is directed to be released on bail on his furnishing bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1, Madhepura in connection with Kumarkhand P.S. Case No. 84 of 2013.
