Mr. Anamul Haque ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 15-05-2025 Heard the learned counsel for the petitioner, learned counsel for the State and the learned counsel for the informant.

2. The petitioner seeks regular bail in connection with Tarabari P.S. Case No. 123 of 2024 registered for the offence under Sections 80, 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the petitioner is the husband of the deceased. He along with others are said to have killed the deceased for demand of dowry.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 19.11.2024. He further submits that the deceased had committed suicide. The deceased had a daughter who is two years old and is staying with the family of the petitioner.

5. Learned A.P.P. appearing for the State as well as the

Patna High Court CR. MISC. No.30861 of 2025(2) dt.15-05-2025 2/2 learned counsel for the informant have vehemently opposed the prayer for bail by submitting that the deceased was killed by the petitioner by pressing her neck.

6. Considering the facts and circumstances of the case, the period of custody as well as the submission of the learned counsel for the petitioner, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Araria/concerned Court below in connection with Tarabari P.S. Case No. 123 of 2024 subject to condition that:- (i). At the time of accepting the bail bonds of the petitioner, the Court below will verify the fact whether the daughter of the deceased is staying with the family of the petitioner or not. If it is found that the child is staying with the family of the petitioner then the bail bonds of the petitioner shall be accepted. If the same is found to be false, then the bail bonds of the petitioner shall not be accepted by the Court below.
