This is an application for regular bail on behalf of the petitioners for the offences alleged under Sections 399 and 402 of the Indian Penal Code registered in connection with S.Tr. No.1533 of 2022 arsing out of Rail Mokama (Hathidah) P.S.Case No. 90 of 2022.

As per allegation, the petitioners along with other accused persons were planning to commit some serious offences and they were apprehended by the police. One knife was recovered from the possession of petitioner no.2 and four pieces of blades were recovered from the possession of petitioner no.1.

Patna High Court CR. MISC. No.32859 of 2023(2) dt.21-06-2023 2/2 The learned counsel for the petitioners has submitted that they are innocent and have falsely been implicated in this case. They are in custody since 22.10.2022.

Considering the above facts and circumstances, let the petitioners, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-XIII, Patna in connection with S.Tr.No. 1533 of 2022, arising out of Rail Mokama (Hathidah) P.S.Case No. 90 of 2022, subject to the following conditions:-

1. The petitioners shall cooperate in the disposal of trial and make themselves available as and when required by the court.

2. If the petitioners are found involved in future in the similar type of offence, their bail bond shall be liable to be cancelled.
