The petitioner seeks bail in a case registered under Section 395 of the Indian Penal Code.

The prosecution case in brief is that the informant who is driver of the tractor proceeded from Bimran to Naubatpur with owner of the truck. In the way, the accused persons riding on motorcycle, asked them to stop the tractor and in noncompliance, they followed the informant. It is also alleged that the accused persons caught the informant and tied him with a tree and also snatched Rs. 2700 and a mobile phone. It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 05-12-2018.

Patna High Court CR. MISC. No.31127 of 2019(2) dt.10-05-2019 2/2 Charge sheet has already been submitted. The petitioner is not named in the FIR. His name transpired in this case on the basis of confessional statement of co-accused. No stolen property is said to have been recovered from possession of the petitioner. On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, the petitioner named above is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Danapur in connection with Bikram P.S. Case No. 165 of 2014.
