This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 21(b)/22(B) of the NDPS Act, registered in connection with NDPS (Special) Case No. 30 of 2022 arising out of Birpur (Bhimnagar O.P.) P.S.Case No. 351 of 2022.
The learned counsel for the petitioner has submitted that the petitioner was not arrested at the spot. Nothing was recovered from his possession and co-accused from whose possession 179 gm of brown sugar was recovered has been granted bail by a coordinate Bench of this Court. The petitioner is a person of clean antecedent.

No.32879 of 2023(2) dt.21-06-2023 2/2 Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, NDPS, Supaul in connection with NDPS (Special) Case No. 30 of 2022 arising out of Birpur (Bhimnagar O.P.) P.S.Case No. 351 of 2022, subject to the following conditions:-
1. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
2. If the petitioner is found involved in future in the similar type of offence, his bail bond shall be liable to be cancelled.
