The writ petition has been filed for the following reliefs :- i) For issuance of a writ in the nature of Mandamus or any other appropriate writ for commanding the respondents to extend and grant of the same benefits such as seniority, annual increments, ACP etc. to the petitioner as has been extended to the similarly situated employees who were appointed earlier pursuant to the same advertisement and panel though the petitioner appointed belatedly due to the action/inaction on the part of the respondent authorities.

ii) For issuance of a writ in the nature of Mandamus or any other appropriate writ for commanding the respondents to extend all the

Patna High Court CWJC No.7483 of 2026(2) dt.14-05-2026 2/3 service benefits to the petitioner as aforesaid by notionally before joining and actually after joining with effect from the date the employees admittedly junior to the petitioner joined and received. iii) For holding that an equal treatment to equally situated employees in the matter of salary, annual Increments, A.C.P. and other service benefits would amount to denial of right to equally enshrined at Article 14 and 16 of the Constitution of India.

iv) For issuance of any other appropriate writ or order(s) or direction(s) which Your Lordships may deem fit and proper in the facts and circumstances of the case.

3. Learned Counsel for the petitioner submits that his case is squarely covered by judgment of Hon'ble Supreme Court in the case of Balwant Singh Narwal and Ors. v. State of Harayana and Ors reported in (2008) 7 SCC 728 and it is the case of the petitioners that relying upon the Hon'ble Apex Court judgment, the Co-ordinate Bench has also decided several cases, one of such case interference given by the Co-ordinate bench in the case of Santosh Kumar and Others v. The State of Bihar and Others, C.W.J.C. No. 15663 of 2021, has been appended with writ petition as Annexure-P/6 and in the light of aforesaid judgments, the petitioner is said to have filed representation, which is pending before let the Director Primary Education Department of Education, for grant of notional pay scale and also consequential benefits, which is needs to be adjudicated

4. On the other hand, learned counsel for the State does not dispute the factual position and submits that the issues may be directed to be adjudicated.

Considering the stand of the parties, this Court directs the representation of the petitioner, which is appended with the writ petition as Annexure-P/7, be adjudicated within a period of eight weeks in light of the judgment passed by the Hon'ble Apex Court and the judgment passed by the Coordinate Bench, which has been appended with the writ petition as Annexure-P/6.
