The petitioner seeks bail in Chanpatia P.S. Case No. 421/2018, instituted for offences under Section(s) 147, 148, 149, 341, 323, 324, 325, 307, 337, 338, 504 and 506 of the Indian Penal Code. Later on Section 302 of the Indian Penal Code was also added.

It is alleged in the written report that on the date of occurrence while informant along with his sons and driver were going to Bettiah for treatment of his mother and he reached near PCC Road, he saw accused persons were dropping soil by three tractors in their field. The informant tried to pass through, then all the accused persons started assaulting. It is alleged that on the order of this petitioner, co-accused Ravi Kant Mishra @

Patna High Court CR. MISC. No.30952 of 2019(3) dt.02-07-2019 2/2 Guddu Mishra and Vinod Mishra assaulted the son of informant with iron rod causing injury on his head. During course of treatment son of informant died.

Learned counsel for the petitioner has submitted that petitioner is only order-giver.

Petitioner is in custody since 26.02.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Vth, West Champaran at Bettiah, in connection with Chanpatia P.S. Case No. 421/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
