25-10-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Sourbazar (Patarghat O.P) P.S. Case No. 340 of 2020, registered for the offence under Sections 147, 148, 149, 323, 341, 307, 302, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, this petitioner alongwith other FIR named accused persons and 5-6 unknown persons came on motorcycle and started assaulting informant and when father of the informant intervened, co-accused Shyamal Yadav fired from his country-made pistol on the waist of father of informant, as a result of which, the father of the informant died on the spot.

It is submitted on behalf of petitioner that specific allegation of causing fire-are injury is against co-accused Shyamal Yadav and so far as this petitioner is concerned, he is

Patna High Court CR. MISC. No.41724 of 2021(2) dt.25-10-2021 2/2 alleged to be member of the mob. Petitioner has got clean antecedent and he is in custody since 09.01.2021. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saharsa in connection with Sourbazar (Patarghat O.P) P.S. Case No. 340 of 2020.
