JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-03-2022 Heard learned counsel for the petitioner and the State. By way of the present application, the petitioner seeks bail in connection with Sitamarhi P.S. Case No.1069 of 2018 registered for the offences punishable under Sections 363, 365, 370, 370A, 372, 373, 376, 120B read with 34 of the Indian Penal Code, sections 3, 4, 5, 6 of the Immoral Traffic (Prevention) Act, sections 4 and 6 of the Protection of Children from Sexual Offences Act, 2012 and Section 75 of the Juvenile Justice (Care and Protection of Children) Act. As per the prosecution case, on secret information raid was conducted in the house of this petitioner and two girls, who were kept in underground cell in the house of this petitioner, were recovered, who disclosed their names as Payal Khatoon and Rachna Kumari. It is alleged that this petitioner
Patna High Court CR. MISC. No.42836 of 2021(3) dt.29-03-2022 2/2 and his wife, Raushan Khatoon, forced them to do prostitution work. Several condoms and other articles have been recovered by the police from that place.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The victim girls were medically examined and the medical board found their age to be 18 years. Petitioner is in custody since 19.05.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail and submits that victim in their statement u/s 164 of the Cr. P. C. supported the prosecution case. Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI-cum- Special Judge, Sitamarhi in connection with Sitamarhi PS case No.1069/2018.
