2. In the present case, the petitioners seek bail in connection with Kharagpur P.S. Case No. 143 of 2024 registered for the offences under Sections 341, 323, 324, 307, 302, 504, 147, 148, 149 and 120(B) of the Indian Penal Code.

3. As per prosecution case, in the background of land dispute, petitioners and other co-accused persons assaulted the husband of the informant causing his death.

4. Learned counsel appearing on behalf of the petitioners submits that the petitioners are innocent and have been falsely implicated in this case. Post-mortem report of the deceased shows only one stitch wound and altogether 10 persons have been

Learned counsel further submits that a number of co-accused persons have been granted anticipatory bail as well as regular bail by different Coordinate Benches of this Court. Case of the petitioners is similarly situated. Petitioners are in custody since 09.04.2025 and chargesheet has been submitted. Petitioners are having clean antecedent.

5. Learned A.P.P. opposes the submission made on behalf of the petitioners. Learned APP submits that petitioners and other co-accused persons assaulted the husband of the informant who lost his life.

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the grant of bail to similarly placed co-accused persons and also considering the period of custody of the petitioners along with their clean antecedent and submission of charge-sheet, the petitioners above named are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned ADJ-II, Munger/concerned court in connection with Kharagpur P.S. Case No. 143 of 2024, subject to the conditions mentioned in Section 480(3) of the B.N.S.S. and other following conditions:

(i) One of the bailors will be a close relative

(ii) The petitioners will remain present on each and every date fixed by the court below.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioners will be liable to be cancelled by the court concerned.
