The petitioner seeks bail in Garkha P.S. Case No. 547 of 2019, registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act.

As per the prosecution case, on secret information that four miscreants are fleeing toward Garkha after committing loot of CSP, Paharpur. On such information, informant along with other police officials proceeded towards the place of occurrence, reached there and saw that villagers have caught hold one person and they were assaulting him. On interrogation, he disclosed his name as Bhula Mahto and disclosed that petitioner and co-accused Sonu Kumar as the persons who fled away from the place of occurrence and he has got no information about fourth person. Patna High Court CR. MISC. No.44025 of 2021(2) dt.01-11-2021 2/2 cartridge was recovered from possession of co-accused Bhula Mahto.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. Name of this petitioner has come in this case on the basis of confessional statement of coaccused Bhula Mahto. Neither arms and ammunition has been recovered nor looted article has been from possession of this petitioner. Petitioner is in custody since 23.04.2021. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Saran at Chapra in connection with Garkha P.S. Case No. 547 of 2019.
