Petitioner No.1- Rambilas Ram @ Belash Ram has already been arrested. Hence, prayer for anticipatory bail is dismissed as infructuous.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 272,273 of I.P.C. and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

From the house of petitioner No.2-Rampukar Ram son of Rambilas Ram @ Belash Ram liquor was recovered. Considering the presumption of law under Section 32

Patna High Court CR. MISC. No.28332 of 2020(2) dt.09-12-2020 2/2 of the Bihar Prohibition and Excise Act as well as consequent bar of prayer for anticipatory bail under Section 76(2), I am not inclined to enlarge the petitioner- Rampukar Ram on anticipatory bail. Hence prayer is refused in connection with Ramgadhwa P.S.Case No.205 of 2020 pending in the court of learned Special Judge, Excise, East Champaran, Motihari. However, in the event of surrender of petitionerNo.2-Rampukar Ram, prayer for regular bail shall be considered without being prejudiced by this order.

The learned Trial Court shall not prejudice by any observation made in this order.
