2. The petitioner seeks pre-arrest bail in connection with Magadh Medical P.S. Case No.246 of 2023, dated 23.05.2023, registered for the offence(s) punishable under Sections 341, 323, 307, 365, 427, and 506 of the Indian Penal Code.

3. As per the allegation made in the F.I.R., the vehicle of the petitioner dashed with the vehicle of the informant and as a result of which scuffle took place between the parties. It is also alleged that the informant was beaten and due to which he sustained injury.

4. Learned counsel appearing on behalf of the petitioner submits that there is case and counter case between the parties arising out of the same incidence. In fact the petitioner's car was dashed by a school bus and as a result of which scuffle took place

Patna High Court CR. MISC. No.37700 of 2024(2) dt.26-06-2024 2/2 between the informant and the Khalasi. In the said incidence, the petitioner without intention may have caused injury on the body of the informant and the Khalasi without any intention.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

Having considered the rival submissions made on behalf of the parties and nature of allegation against the petitioner, the petitioner, above named is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail-bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, II, Gaya in connection with Magadh Medical P.S. Case No.246 of 2023, subject to the condition as laid down under Section 438(2) of the Cr.P.C.

7. The bail application stands disposed of.
