2. The petitioner apprehends his arrest in a case registered for the offence under Section 420 of the Indian Penal Code and Section 10 of the Bihar Conduct of Examination Act, 1981.

3. It is a case of cheating by personation. It is alleged that in place of this petitioner, one Abhishek Kumar appeared in Intermediate Examination, 2021.

4. It is submitted on behalf of petitioner that on the alleged date, petitioner was suffering from fever and as such, he could not appear in the said examination and he has no knowledge about other co-accused Abhishek Kumar, who had appeared in the said examination. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Supaul P.S. Case No. 77 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
