The petitioner seeks bail in connection with Barahiya P.S. Case No.125 of 2023 registered for the offence under Sections 302, 307, 324/34 of the Indian Penal Code. 3.

Allegation against the petitioner is to have committed murder of son of the informant.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that the deceased had died in natural death as he was aged about 90 years. It is submitted that allegation as regard to assault is not specific against this petitioner rather the allegation is general and

Patna High Court CR. MISC. No.34692 of 2024(3) dt.05-08-2024 2/2 omnibus in nature. It is further submitted that petitioner is a man of clean antecedent and he is in custody since 29.05.2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

In view of the submissions, as made above, as it appears from perusal of case diary as well as impugned order that the witnesses have supported the prosecution story and as it appears from case diary that during investigation, Investigating Officer found the case to be true against this petitioner and other three co-accused have not sent up before the learned Magistrate and as it appears from postmortem that total 7 antemortem injuries found upon the body of the deceased, Bal Kishore Singh and as specific allegation has been levelled against this petitioner, this Court is not inclined to grant bail to the petitioner, at present.

Accordingly, the prayer of bail of the petitioner is rejected herewith.
