JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 02.02.2014 in a case registered for the offences punishable under Sections 328, 307, 379 and 411 of the Indian Penal Code.
It is alleged that after administering intoxicant to the informant, his bag containing Nokia and Samsung Mobiles were taken away. Subsequently, Nokia mobile was recovered from the possession of the petitioner.
It is submitted by learned counsel for the petitioner that the petitioner was not put on T.I. parade and mere recovery of the alleged mobile does not reflect that the petitioner actually committed the offence under Sections 328 and 379 of the IPC. The petitioner is accused in one other case apart from present one. Considering the nature of accusation and period under

No.33263 of 2014 (3) dt.09-01-2015 2/2 custody, let the above named petitioner, be released on bail, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Sonepur in connection with Muzaffarpur Rail P.S. Case No. 21 of 2014.
