1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 272 and 273/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

3. Learned counsel for the petitioner submits that petitioner has antecedent of one case.

4. Allegation is of recovery of 498 litres of liquor from a car out of which 48 litres of bear.

5. Learned counsel for the petitioner submits that petitioner had taken lift in the car and as such was not aware that liquor was being transported. It is further submitted that petitioner is not the owner of the seized vehicle and is in custody since 24.08.2023.

6. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

7. Considering the submissions made by the learned counsel for the petitioner and the period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Ladaniya P.S. Case No. 228 of 2023 corresponding to G.R. No. 1275 of 2023.
