JUSTICE ANIL KUMAR SINHA ORAL ORDER 03-02-2022 Heard Mr. Surendra Kumar Mishra, learned counsel for the petitioner and Mr. Jagdhar Prasad, learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Begusarai Mufassil PS Case No. 429/2020 registered for the offence punishable under Sections 324, 307, 120B/34 of the IPC and Section 27 of the Arms Act.

The allegation, in a nutshell, is that the petitioner along with other accused persons arrived at the door of the informant and fired from the pistol and rifle due to which the bullet hit the abdomen of the son of informant, namely, Vikram Raj.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case due to land dispute with one Pankaj Chaudhary and the petitioner has not committed any offence in the manner alleged. He referring to para-12 of this petition

Patna High Court CR. MISC. No.43093 of 2021(2) dt.03-02-2022 2/2 submits that during course of investigation statement of wife and driver of the informant has been recorded in para-5 and 8 of the case diary and they have stated that the co-accused, Pankaj Chaudhary fired upon the informant due to land dispute but the bullet hit the son of the informant. Referring to Annexure-2, learned counsel further submits that the injury, sustained by the victim boy, is simple in nature.

Learned counsel also submits that the petitioner is in custody since 03.04.2021 and he has got no criminal antecedent. Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that the firing was not made by the petitioner, he is in custody since 03.04.2021 and he has got no criminal antecedent, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, RANJEET SINGH be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Mufassil PS Case No. 429/2020.
