JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2019 This is an application for grant of anticipatory bail in connection with Nawada P.S. Case No. 143 of 2019, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Prosecution case is that police intercepted two persons Md. Haidar and Imtiyaj Khan and recovered 30 liters of Toddy from them and they disclosed the name of the petitioner that the Toddy is of petitioner and apart from that it appears that he is an accused in one more case of similar type of allegation. Submission of the learned counsel for the petitioner is that except confessional statement of co-accused there is nothing against the petitioner.

Heard learned A.P.P. also, who opposed the prayer for anticipatory bail on the ground that only confessional statement

Having heard both sides, in view of the allegation, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, she may surrender before the learned court below and make prayer for regular bail, which shall be considered by the learned court below on its own merit, and if possible to be disposed of on the same day.
