Mr. Dhanajay Kumar No. 2, learned counsel for the petitioners seeks permission to withdraw the application with respect to petitioner no. 1.
This application with respect to petitioner no. 1 /Kartush Raut stands dismissed as withdrawn. The petitioner nos. 2 and 3 seek bail in anticipation of their arrest in connection with Bettiah Town
Patna High Court CR. MISC. No.26481 of 2020(2) dt.21-10-2020 2/2 P.S. Case No. 749 of 2019 instituted for the offence under Sections 354, 354(B), 506 and 34 of the Indian Penal Code and Section 8/11 of the POCSO Act.
It has been submitted on behalf of the petitioners that nothing specific has been alleged against petitioner nos. 2 and 3 except for their having helped petitioner no. 1. However, I am not inclined to grant anticipatory bail to petitioner nos. 2/Shivshankar Raut and 3/Pawan Kumar.
Their prayer for grant of anticipatory bail is rejected.
However, if the petitioner nos. 2 and 3 surrender before the court below and seeks bail, their cases shall be decided on its own merit without being prejudiced by the fact that the present petition has not been entertained. (Ashutosh Kumar, J) sunilkumar/- U T
