Petitioners seek regular bail in a case registered for the offence punishable under Section 307 and some other allied Sections of the Indian Penal Code and and u/s 27 of Arms Act. As per the prosecution case, these two petitioners caused gun shot injuries to Mukesh Sharma and Sanjeev Sharma.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case due to old land dispute between the parties. There is case and counter case and these petitioners also sustained fire

Patna High Court CR. MISC. No.42185 of 2021(2) dt.03-01-2022 2/2 arm injuries caused by the prosecution side. Petitioners are in custody since 05.02.2021 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case and the period of custody of the petitioners, let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Banka in connection with Amarpur PS case No.133/2020.
