The petitioner seeks regular bail in Phulwari Sharif P.S.case No. 684 of 2013 under Sections 364/34 of the Indian Penal Code.

The mother of the victim boy Pawan Kumar alleged that her son went with Neeraj Numar Pathak (petitioner) and Vishal Kumar but he did not return.

Learned counsel for the petitioner submits that the petitioner was a good friend of Pawan Kumar. There is absolutely no evidence to show that the petitioner played any role in kidnapping the said boy. Pawan Kumar went some where but he did not return. It appears during course of investigation that the witnesses have only said that Pawan Kumar was found in the company of the petitioner. It has come in the case diary that

Patna High Court Cr.Misc. No.29174 of 2014 (4) dt.12-01-2015 2/2 Pawan Kumar wanted to sell and purchase Ganja and he was talking about selling of Ganja with one Sintu Kumar. The petitioner is in custody since 09/03/2014.

Considering the facts, let the above name petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Patna, in Phulari Sharif P.S.Case No. 684/2013 corresponding to G.R.No. 7069 of 2013.
