1. Heard learned counsel for the parties.
2. The petitioner in this application prays for grant of anticipatory bail apprehending his arrest in connection with Muzaffarpur Sadar P.S. Case no.337 of 2012 registered for the offence punishable under sections 367 and 368 of the Indian Penal Code.
3. As per allegation in the F.I.R, the informant states that on the pretext of getting him employment, the wife of the petitioner took Rs. 3 lakhs from his son. On not getting him employed and on demand, the petitioner's wife returned Rs. 1 lakh but cheated him of Rs.2 lakhs.
4. Learned Senior counsel appearing for the petitioner submits that the petitioner has been falsely implicated in the case. No such occurrence as alleged has taken place.
Patna High Court CR. MISC. No.34809 of 2024(2) dt.17-05-2024 2/2 Even as per the allegations in the FIR, the allegation is mainly against the wife of the petitioner and not the petitioner. Coaccused Shweta Singh has been enlarged on bail vide order dated 2.4.2024 passed in Cr. Misc. no. 20593 of 2024. The petitioner has no criminal antecedent.
5. The application for bail is opposed by learned APP for the State who submits that so far as coaccused Shweta Singh is concerned, she was enlarged on regular bail.

Having heard learned counsel for the parties and taking into consideration the nature of allegation in the F.I.R., the allegation mainly being against the petitioner's wife Shweta Singh who has already been enlarged on bail vide aforesaid order dated 2.4.2024 together with the petitioner not having any criminal antecedent, it is directed that the petitioner, in the event of his arrest or surrender before the learned Court below within a period of six weeks, be released on anticipatory bail in connection with Muzaffarpur Sadar P.S. Case no. 337 of 2012 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur.
