JUSTICE ASHUTOSH KUMAR ORAL ORDER 05-11-2018 The petitioners seek modification of the order dated 17.03.2008 passed in Cr. Misc. No. 994 of 2008 whereby the petitioner was granted anticipatory bail subject to his surrendering within four weeks of the passing of the order.
Learned counsel for the petitioners submits that for the lack of communication from the end of the learned advocate who was contesting this matter, the petitioners could not surrender before the court below on time.
However, considering the fact that the order is of the year 2008, I am not inclined to modify the
Patna High Court Cr.Misc. No.60846 of 2018(2) dt.05-11-2018 2/2 aforesaid order.
The petition is, accordingly, dismissed.
If so advised, the petitioner may apply afresh for grant of anticipatory bail before the Sessions court which shall be decided on its own merits without being prejudiced by the fact that the present petition has not been entertained.
