Mr. Smt. Anita Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 13-12-2018 Heard the learned counsel for the petitioner and the State.

The petitioner seeks bail in anticipation of his arrest in connection with Ramnagar P.S. Case No. 460 of 2017 dated 08.12.2017 instituted for the offences under Sections 379, 504, 506 and 34 of the Indian Penal Code.

The allegation in the FIR is of cutting the timber trees and causing their disappearance. When protest was raised by the informant, the petitioner is alleged to have abused and threatened the informant. The loss which has occurred to the informant has been quantified at Rs. 2 lakhs.

Learned counsel appearing for the petitioner has submitted that the accusation is only on the basis of

Patna High Court Cr.Misc. No.64018 of 2018(2) dt.13-12-2018 2/2 guess work and under similar circumstances one of the accused persons has been granted anticipatory bail by a bench of this Court vide order dated 05.04.2018 passed in Cr. Misc. No. 13173 of 2018.

The petitioner does not have any criminal antecedent.

For the aforestated facts, the petitioner above named is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Bagaha, West Champaran in connection with Ram Nagar P.S. Case No. 460 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
