16-12-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Garkha P.S. Case No. 107 of 2019, registered for the offence under Sections 395 / 397 of the Indian Penal Code.

The F.I.R. is of occurrence of dacoity against unknown.

It is submitted on behalf of petitioner that name of the petitioner has transpired during course of investigation on the basis of confessional statement of co-accused Pappu Manjhi. No incriminating article has been recovered from the possession of the petitioner and till date, petitioner has not been put on T.I.P. Similarly situated co-accused Raju Singh has already been granted bail by this Court, vide order dated 04.06.2020 passed in Cr.Misc. No. 79506 of 2019. Petitioner is in custody since 22.03.2021.

Patna High Court CR. MISC. No.41420 of 2021(2) dt.16-12-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Saran at Chapra in connection with Garkha P.S. Case No. 107 of 2019.
