The petitioner apprehends his arrest in Madanpur P.S. Case No. 125/2018, instituted for offences under Sections 409, 420, 406/34 of the Indian Penal Code.
Earlier prayer for anticipatory bail of the petitioner was rejected by order 27.08.2018 passed in Cr. Misc. No. 40821/2018.
The petitioner has filed fresh anticipatory bail petition on the ground that Sarita Kumari and Ramesh Kumar Singh have already been granted anticipatory bail by a Coordinate Bench of this Court in Cr. Misc. No. 39490/2018 and 40003/2018 dated 03.08.2018.
Learned counsel for the petitioner has submitted that
Patna High Court Cr.Misc. No.64200 of 2018(2) dt.16-01-2019 2/2 departmental enquiry has already been concluded. This Court finds that earlier order passed by this Court in Cr. Misc. No. 40821/2018 dated 27.08.2018 is speaking order. This Court does not find any new facts except that other co-accused have already been granted anticipatory bail by a Coordinate Bench of this Court. In such circumstances, this Court is not inclined to grant anticipatory bail to petitioner. The petitioner is directed to surrender before the Court below within eight weeks from the date of receipt/production of this order and pray for regular bail, which shall be considered by the court below in accordance with law on its own merit without being prejudiced by this order. Petitioner will be at liberty to bring all the facts as argued in this Court to the notice of court below. The court below shall dispose of the bail petition of petitioner in accordance with law preferably on the same day. (Sanjay Priya, J) rakhi/- U T
