The petitioner apprehends her arrest in Hajipur Town P.S. case No. 385 of 2016 registered under Section 366(A), 120B/34 of the IPC.
The learned counsel for the petitioner submits that prayer of petitioner for anticipatory bail was earlier rejected vide order dated 10.01.2017 passed in Cr. Misc. No. 46480 of 2016 but the petitioner again moved for grant of anticipatory bail as some of the accused are facing trial and during the course of trial the victim was examined but she did not support the case. It is submitted that petitioner being a lady deserves anticipatory bail but it appears that prayer of petitioner for anticipatory bail was rejected on the ground that it was the petitioner who called
Patna High Court CR. MISC. No.32439 of 2019(2) dt.24-07-2019 2/2 the minor victim to her house and gave her some food and thereafter the victim became unconscious and she was got kidnapped. Thereafter, the petitioner evaded her appearance in court for more than two and half years and waited for the result of trial of other accused. On this ground alone that petitioner evaded her appearance in the court and watched the proceeding from outside the court for more than two and half years, I am not inclined to enlarge the petitioner on anticipatory bail and the same is once again rejected.
