JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 21-06-2022 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in a case registered for the offence punishable under Section 366A and other allied sections of the Indian Penal Code.

Learned counsel appearing for the petitioners submits that the petitioners are innocent and have falsely been implicated in this case. He submits that the victim in her statement recorded under section 164 Cr. P. C. has stated that it was co-accused Lalu Kumar Turi who caught her and put pressure on her mouth, thereafter all the accused persons including the petitioners were planning to sell her. There is

Patna High Court CR. MISC. No.41757 of 2021(3) dt.21-06-2022 2/2 general and omnibus allegation against the petitioners and no specific overt act has been alleged against them. It is further submitted that the FIR was lodged after delay of 25 days and there is no plausible explanation of delay. Petitioners have got no criminal antecedent.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioners, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in Belhar Police Station Case No. 81/2020, subject to the conditions laid down under sections 438(2) of the Code of Criminal Procedure.
