The petitioner is languishing in custody in a case registered for the offences punishable under Sections 379/411 of the Indian Penal Code.

The petitioner is alleged to have stolen away the mobile of the informant but on raising alarm, he was apprehended and mobile of the informant was recovered from his possession.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. Nothing has been recovered

Patna High Court CR. MISC. No.43315 of 2023(2) dt.28-07-2023 2/2 from the conscious possession of the petitioner. The petitioner has no concern with the recovery of mobile of the informant. The petitioner is languishing in custody since 03.10.2022.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Railway Magistrate, Patna in connection with GRP(Patna) P.S. Case No. 574 of 2022.
