Petitioner is apprehending arrest in connection with Barun P.S. Case No. 35 of 2017 for the offence under sections 379, 411, 420 and 120(B) of the Indian Penal Code and 3, 4 and 5 of Bihar Mines Act and Section 33, 41, 42 of the Indian Forest Act.
Learned counsel for the petitioner submits that petitioner has no criminal antecedent.
The instant case was registered in connection with illegal transportation of stone chips. The petitioner is owner of the vehicle.
Learned counsel submits that similarly circumstances other co-accused have been granted anticipatory
Patna High Court Cr.Misc. No.62852 of 2018(2) dt.13-12-2018 2/2 bail by way of Annexure-2 series namely, Sunil Kumar in Cr. Misc. No. 30009 of 2017 vide order dated 13.7.2017 and Chandan Kumar in Cr. Misc. No. 35304 of 2017 vide order dated 8.9.2017.
Considering the aforesaid, let the petitioner, named above, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No. 35 of 2017 subject to the condition as laid down under section 438(2) of the Cr.P.C.
