2. The petitioner has prayed for regular bail in a case registered for the offences punishable under Sections 318(4), 303(2) and 3(5) of the BNS, 2023.

3. The case of the prosecution, in short, is that two persons offered water to the informant and, after she became unconscious, her jewellery was looted away.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It has further been submitted that the FIR was instituted against unknown miscreants and, during investigation, one Bansi Dom gave his confessional statement alleging that he had sold the stolen articles to the petitioner. No.31036 of 2026(2) dt.11-05-2026 2/2 the petitioner further submits that nothing has been recovered from the possession of the petitioner and, save and except the confessional statement of the co-accused, there is no material against him. It is also submitted that the petitioner is languishing in judicial custody since 02.03.2026 and has only one criminal antecedent.

5. Learned APP appearing for the State has opposed the prayer for regular bail.

6. Considering the aforesaid facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. Accordingly, the above-named petitioner is directed to be released on bail in connection with Bhagwan Bazar P.S. Case No. 128 of 2026 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Saran at Chapra.
