The appellant is aggrieved by the order dated 07.07.2020 passed by the Exclusive Special Judge, SC/ST Act, Gaya in Imamganj P.S. Case No. 197 of 2019 registered for the offences under Sections 323, 341, 504/34 IPC and Sections 3(i) (r)(s) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, whereby prayer for grant of regular on behalf of the appellant has been rejected.

Allegation against the appellant is that in the absence of husband of the informant, the appellant assaulted the informant by fists and slaps.

Learned counsel appearing on behalf of the appellant would submit that the appellant has no criminal antecedent. The

Considering the aforesaid fact situation particularly the fact that the appellant has no criminal antecedent, the impugned order dated 07.07.2020 is set aside and the appeal is, accordingly, allowed.

Let the appellant, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the Exclusive Special Judge SC/ST Act, Gaya in connection with Imamganj P.S. Case No. 197 of 2019.
