JUSTICE ANIL KUMAR SINHA ORAL ORDER 31-01-2022 Heard Mr. Ranjeet Kumar Singh, learned counsel for the petitioner and Mr. Nagendra Prasad, learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Mansi PS Case No. 43/2020 registered for the offence punishable under Sections 341, 504, 307/34 of the IPC and Section 27 of the Arms Act.

As per allegation, at the exhortation of the petitioner co-accused, namely, Rajbali Yadav fired upon the informant due to which he sustained fire arm injury.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case mainly because he happens to be father of co-accused, Rajbali Yadav. He further submits that petitioner is an old person of 70 years of

Petitioner is in custody since 31.03.2021 having no criminal antecedent. Learned counsel next submits that from perusal of the FIR, it would be evident that petitioner is, at best, an order giver.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner, being 70 years old, is in custody since 31.03.2021 having no criminal antecedent, charge-sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, VIDYA NAND YADAV @ BINDO YADAV be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Mansi PS Case No. 43/2020 (GR No. 403/2020).
